Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Chue ("Chue", "we", "us", or "our") and govern your use of the Chue mobile application, the website at chue.app, and all related features and content (together, the "Services"). Please read them carefully, together with our Privacy Policy, which is incorporated by reference.

By creating an account, downloading the app, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services. Section 21 contains a binding arbitration clause and a class-action waiver that affect how disputes are resolved.

1. Definitions

  • "App" — the Chue application for iOS and Android.
  • "Database" — the regulatory, ingredient, and nutrition data Chue assembles from public and third-party sources to compute a Score.
  • "Score" — the 0–100 value Chue computes for a product, together with its flags and explanations.
  • "Premium" — the paid subscription tier described in Section 9.
  • "Content" — text, images, and other material made available through the Services, including the Database and material you submit.
  • "You" — the person using the Services.

2. Our mission and independence

Chue exists to help you understand what is in the food and personal-care products you buy. Our analysis is independent: no brand, manufacturer, or industry group can pay to influence a Score, to remove a flag, or to advertise to you inside the app. Scores are computed from published regulatory positions and nutrition data, not from opinions and not from anyone's marketing budget.

3. How Chue works

Chue reads a product's barcode (or identifies it from a photo) and assembles its nutrition facts, ingredient panel, and regulatory flags from public and third-party sources such as Open Food Facts, USDA FoodData Central, and others listed in the app and FAQ. It then computes a Score that weighs nutrition quality, ingredient and additive risk, and processing, and it cites the regulatory bodies behind each flag (for example the FDA, EU EFSA, IARC classifications, and national bans).

Scores are indicative and general in nature. They reflect the data available for a product at the time of the scan and the methodology then in use, which we may refine over time. Premium features (described in Section 9) add unlimited scans, photo identification, the cleaner-alternatives carousel, the tap-water grade detail, the community feed, sorting, and unlimited history.

4. Eligibility

You must be at least 13 years old to use Chue. If you are between 13 and the age of majority where you live, you may use Chue only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf. By using the Services you represent that you meet these requirements and that you are not barred from using the Services under any applicable law.

5. Your account

You sign in with your email, Apple, or Google so we can sync your scan history, pantry, and profile across your devices. You are responsible for keeping your sign-in credentials secure and for all activity under your account. One person, one account. Tell us promptly at hello@chue.app if you believe your account has been compromised. We may suspend or close accounts as described in Section 18.

6. License to use Chue

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, and to use the Services, for your own personal, non-commercial purposes. This license does not transfer any ownership in the Services or Content to you, and all rights not expressly granted are reserved.

7. Acceptable use

You may use Chue for any lawful personal purpose, including sharing screenshots of your own scans on social media. You agree that you will not:

  • Scrape, harvest, mirror, or republish the Database, Scores, or any substantial part of the Services in bulk, or use them to build a competing product.
  • Reverse-engineer, decompile, or attempt to extract the source code or algorithms, except to the extent this restriction is prohibited by law.
  • Use Chue to defame, harass, or make false claims about a specific manufacturer beyond what the underlying regulatory data states.
  • Submit false, misleading, or unlawful information to the community feed.
  • Interfere with, overload, probe, or attempt to breach the Services or their security, or access them through automated means without our permission.
  • Use the Services in violation of any applicable law or third-party right.

8. Community content

If the community feed is available to you, you may post text and references about products. You are solely responsible for what you submit, and you represent that you have the right to submit it and that it does not violate these Terms or any law.

You retain ownership of what you write. You grant Chue a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, reformat, display, and distribute your contributions within the Services in order to operate and promote the community feature. We may remove or refuse any contribution that violates these Terms or applicable law, and we may moderate, limit, or discontinue the community feature at any time. We do not endorse user contributions, and they do not represent Chue's views.

9. Subscriptions, billing, and renewals

The free tier includes 5 scans per day, hazard flags, banned-abroad warnings, and full source citations. Chue Premium ($19.00 per year or $3.99 per month, with a 7-day free trial on the annual plan) unlocks unlimited scans, photo identification, the cleaner-alternatives carousel, the tap-water grade detail, the community feed, sorting, and unlimited scan history. Prices are in U.S. dollars, may vary by region, and are inclusive of taxes where required.

Subscriptions are sold and billed through the Apple App Store or Google Play, not directly by Chue. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions renew automatically at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.

We may change Premium pricing or features. If a change affects your active subscription, we will give you notice (at least 30 days where required) before it takes effect, and where the platform or law requires, your consent or the chance to cancel. Your continued subscription after a change takes effect constitutes acceptance of the new price.

10. Free trial, cancellation, and refunds

If you start a free trial, you will not be charged until the trial ends, and the subscription will begin automatically unless you cancel before the trial period is over. Any unused portion of a free trial is forfeited when you purchase a subscription.

You can cancel at any time through your platform's subscription settings (Apple: Settings → your name → Subscriptions; Google Play: Play Store → Subscriptions). Cancellation stops the next renewal; your access continues until the end of the period you already paid for. Refunds are handled by Apple or Google under their policies, not by Chue — we do not control or directly issue platform refunds. You can also delete your account at any time from the Profile screen.

11. Not medical advice

Chue is an information service, not a medical device, and it does not provide medical, dietary, or professional health advice. Scores are not diagnoses, prescriptions, or recommendations to consume or avoid any product. The app does not know your individual medical history, allergies, intolerances, medications, pregnancy status, or specific dietary needs, and it cannot account for them.

Do not use Chue in place of a qualified professional. If you have a health condition, a food sensitivity, or a severe allergy, read the actual product label, contact the manufacturer, and consult a doctor, dietitian, allergist, or pharmacist before relying on any Score. If you have ever experienced, or are at risk of, disordered eating, please be aware that a tool that scores food may not be appropriate for you; speak with a healthcare professional. If you think you are having a medical emergency, call your local emergency number. You use Chue's information at your own risk and remain solely responsible for what you choose to put in or on your body.

12. Data accuracy

Chue's Scores are computed from public regulatory data and third-party databases (such as Open Food Facts, USDA FoodData Central, and others) and from the ingredient and nutrition panels those sources supply. Errors, omissions, or out-of-date entries in those sources will produce errors in Chue, and a product's formulation may change without the databases being updated. We do not warrant that any specific Score, flag, ingredient match, or nutrition figure is correct, complete, or current. Always read the actual label on the product you are about to use.

13. Intellectual property

The Services, including the App, the Database, the scoring methodology and algorithms, the Chue name and logo, and all related Content (other than material you submit), are owned by Chue or its licensors and are protected by intellectual-property laws. Except for the limited license in Section 6, nothing in these Terms grants you any right, title, or interest in the Services or Content. You may not use the Chue name or marks without our prior written permission.

14. Third-party services and content

The Services rely on and link to third-party data sources, sign-in providers, payment platforms, and other services. We do not control and are not responsible for third-party services or content, and your use of them may be governed by their own terms and policies. Reference to a regulator, brand, or source does not imply their endorsement of Chue.

15. Disclaimers of warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any Score or result will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

16. Limitation of liability

To the maximum extent permitted by law, Chue and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or related to the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Chue and its officers, employees, and suppliers from any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of your misuse of the Services, your violation of these Terms or any law, or your contributions to the community feed.

18. Termination

You may stop using the Services at any time and may delete your account from the Profile screen or by emailing us. We may suspend or terminate your access if you violate these Terms or applicable law, if required for security or legal reasons, or if we discontinue the Services. If we terminate your account other than for cause, any active paid subscription will run through the end of the current billing period. Sections that by their nature should survive termination (including Sections 11–17 and 20–23) will survive.

19. Changes to the Services and these Terms

We may modify, add, or discontinue features of the Services at any time. We may also update these Terms; if we make a material change, we will post the updated Terms here with a new "Last updated" date and, where appropriate or required, notify active users at least 30 days before the change takes effect. Your continued use of the Services after the effective date means you accept the revised Terms. If you do not agree, stop using the Services and delete your account.

20. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except that the Federal Arbitration Act governs Section 21. Subject to Section 21, any dispute not subject to arbitration will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction — unless the mandatory consumer-protection law of your home jurisdiction provides otherwise.

21. Dispute resolution and arbitration

Please read this section carefully — it affects your legal rights.

Informal resolution first. Before starting any formal proceeding, you agree to contact us at legal@chue.app and give us 60 days to resolve the dispute informally. Most concerns can be sorted out this way.

Binding arbitration. If we cannot resolve a dispute informally, you and Chue agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in the county of your residence or another mutually agreed location, or by phone or video where available.

Class-action and jury waiver. You and Chue agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding, and each party waives any right to a jury trial. The arbitrator may not consolidate more than one person's claims.

30-day opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@chue.app with your account email and the statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.

Time limit. Any dispute must be filed within one year after it arises, to the extent permitted by law. If any part of this Section is found unenforceable, the rest remains in effect, except that if the class-action waiver is found unenforceable, this entire Section 21 is void.

22. Apple App Store and Google Play terms

This Section applies when you obtain the App through the Apple App Store or Google Play and supplements the rest of these Terms. If it conflicts with the platform's own terms as to your use of the App, the platform's terms control for that issue.

For the Apple App Store:

  • These Terms are between you and Chue only, not with Apple. Apple is not responsible for the App or its content.
  • Apple grants you the right to use the App under the usage rules in the Apple Media Services Terms, on any Apple device you own or control as permitted there.
  • Chue, not Apple, is solely responsible for the App and for providing any maintenance and support, which Apple has no obligation to furnish.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are Chue's responsibility.
  • Chue, not Apple, is responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or privacy law.
  • If a third party claims the App infringes intellectual-property rights, Chue, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

For Google Play: your use of the App is also subject to the Google Play Terms of Service, and you agree that Google is not responsible for the App or for providing support, and that subscriptions obtained through Google Play are governed by Google's billing and refund policies.

23. General provisions

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Chue about the Services and supersede any prior agreement on that subject.

Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest will remain in full force.

No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.

Notices. We may give you notice by email or within the app. You can reach us at the address below.
